Terms and Conditions

1. Interpretation


1.1 The following definitions and rules of interpretation apply:

"August Rock Adventures" refers to the trading name of Helford Powerboat Charters Limited, company number 11800884.

"Conditions" means these terms and conditions.

"Contract" means the agreement between August Rock Adventures and the Customer for the provision of services.

"Customer" means the person, company, or legal entity placing an order with August Rock Adventures.

"Service" refers to any product, service, or facility offered.


1.2 "We", "us", or "our" refers to August Rock Adventures; "you", "your", or "yourself" refers to the Customer.


1.3 Headings are for convenience only and do not affect interpretation.


1.4 References to laws include amendments and subordinate legislation.


1.5 "Writing" or "written" includes emails and faxes.

2. Application of Terms


2.1 These Conditions govern all contracts with August Rock Adventures.


2.2 Any conflicting customer terms are excluded.


2.3 A contract is formed when:

2.3.1 We issue written acknowledgement; or

2.3.2 We begin providing the service.


2.4 Customer terms in purchase orders or other documents are not accepted.

3. Booking


3.1 Bookings can be made via phone, email, or our website.


3.2 Full payment is required to confirm a booking.


3.3 Making a booking constitutes full acceptance of these terms.


3.4 A waiver must be signed before the trip begins.

4. Payment


4.1 All services are subject to VAT at the applicable rate.


4.2 Commercial bookings are also subject to standard VAT.


4.3 Child prices apply to those under 16 on the day of the trip.

5. Cancellations or Amendments by the Customer


5.1 Must be made by phone or email.


5.2 Amendments are permitted up to 24 hours before the trip, subject to availability.


5.2.1 Price differences apply accordingly.


5.3 Cancellations made at least 24 hours before departure receive a full refund.


5.4 Less than 24 hours’ notice:

5.4.1 No amendments permitted.

5.4.2 No refunds.

5.4.3 No-shows receive no refund.


5.5 Bookings are non-transferable.


5.6 Customers should ensure adequate insurance is in place.

6. Cancellation by August Rock Adventures


6.1 We may cancel due to weather, mechanical issues, or commercial reasons.


6.2 In such cases, customers may choose:

- An alternative trip/charter; or

- A full refund.


6.3 We may cancel at any time due to health issues (see clause 8).


6.4 We may cancel if a passenger appears under the influence (see clause 10).

7. Safety


7.1 Fast boat trips carry inherent risks.


7.2 Customers must comply with all safety instructions.


7.3 Improper inflation of lifejackets incurs a £40 re-arming fee.

8. Health


8.1 Trips are adventurous and strenuous.


8.2 Expect sudden movements and shocks.


8.3 Customers must be in good health and consult a doctor if unsure.


8.4 Not suitable for individuals who:

- Are pregnant

- Have back, neck, or knee issues

- Have bone-weakening conditions

- Cannot maintain the safe seated position


8.5 Non-standard itineraries may be available by prior arrangement.


8.6 Customers must disclose any medical conditions that may affect safety.


8.7 Bring all personal medication.


8.8 We may refuse a booking if safety is compromised.


8.9 Do not board if exhibiting COVID-19 symptoms or exposed to such.

9. Gift Vouchers Issued as Prizes


9.1 Prize vouchers are non-transferable, non-refundable, and have no cash value.


9.2 Valid for 12 months unless stated otherwise.


9.3 Subject to availability; blackout dates and restrictions may apply.


9.4 Only one voucher per booking unless agreed in writing.


9.5 Lost, stolen, or damaged vouchers are not replaced.


9.6 Proof of identity or competition entry may be requested.


9.7 Terms may be amended or withdrawn in case of misuse.


9.8 Use of a voucher indicates acceptance of these terms.

10. Alcohol and Intoxicating Drugs


10.1 Boarding is prohibited if intoxicated. No refunds apply.

11. Intellectual Property


11.1 All website, leaflet, and promotional material content remains our property.

12. Limitations of Liability


12.1 This clause governs our liability:

12.1.1 For breach of contract

12.1.2 For use of services

12.1.3 For torts including negligence


12.2 All implied terms are excluded to the fullest extent permitted by law.


12.3 Nothing excludes liability for:

12.3.1 Death or injury due to negligence

12.3.2 Fraud or fraudulent misrepresentation


12.4 Personal property is your responsibility unless loss arises from our negligence.


12.5 We are not liable for:

- Loss of profits, business, goodwill, data, or indirect losses

- Liability is limited to the price paid


12.6 We are not liable for damage caused by your own actions.


12.7 You are advised to arrange insurance and medical cover.

13. Photographs and Video


13.1 Media may be captured during trips and used in marketing unless you object beforehand.

14. Circumstances Beyond Our Control


14.1 We are not liable for non-performance caused by events outside our control (e.g., weather, strikes, pandemics).

15. Rights of Third Parties


15.1 Only parties to this agreement have enforceable rights under it.

16. Waiver


16.1 We may waive any clause at our discretion.

17. Applicable Law


17.1 These Conditions are governed by English and Welsh law.


17.2 Disputes are subject to the exclusive jurisdiction of courts in England and Wales.

18. Complaints


18.1 Please contact us at info@augustrockadventures.co.uk with any concerns within 14 days of your trip. We aim to respond within 10 working days.

19. Privacy and Data Protection


19.1 We process personal data in accordance with UK GDPR and the Data Protection Act 2018. See our Privacy Policy [insert link] for details.

20. Children and Age Restrictions


20.1 All children under 16 must be accompanied by a responsible adult.


20.2 Minimum age for participation is 5 years unless otherwise agreed in writing.


20.3 We reserve the right to refuse boarding to any child for safety reasons.
